Tribal Casinos Have Different Rules as They Are Not Located On Federal Land

South Dakota legalized sports betting in November 2020 through a ballot initiative, with legislators passing a retail-only permit for casinos in Deadwood and some tribal gaming facilities. Gambling in North Carolina is operated solely through the Cherokee Tribe, and the state passed a bill in July 2019 allowing sports gambling (including horse racing) as part of this monopoly. No bill has been passed, but Native American tribes have interpreted sports betting as being legal in tribes casinos, as per existing state-tribal compacts on gambling.

Native American tribes are the only groups allowed to offer casino gambling in Oregon, and Oregon is home to nine Native American casinos on tribal land. More than 20% of U.S. gambling revenue is generated from casinos owned by various Native American tribes.

Native American gaming comprises casinos, bingo halls, and other gambling operations located on Indian reservations or on other tribal land within the United States. Two Native American casinos are among the four largest casinos in the world by gaming floor area. Approved by voters in 2004, the Oklahoma State-Tribal Gaming Act created a tribal gaming compact allowing federally recognized American Indian tribes to operate, electronic Bingo-style Bingo, Electronic Amusement Games, Electronic Instant Bingo, and Non-House-Backed Card games.

In 1988, Congress passed the Indian Gaming Regulatory Act (IGRA) (signed by President Ronald Reagan), which maintained the sovereignty of the tribes in creating casino-like rooms, but states and the Native Americans had to agree in a compact between the tribes and the states, and the federal government had authority to regulate gaming. IGRA compromised somewhat, saying the tribes had sovereignty to create casinos and other gambling facilities, but they had to form Tribal-State Compacts in order to do so. If a state allows casino gambling and has a federally recognized tribe, it is more than likely the tribe will try to negotiate a Tribal-State Compact.

By comparison, states and localities collected $8.6 billion in tax revenue from casinos not affiliated with a tribe in 2012, according to data from the American Gaming Association. Under the Indian Gaming Regulatory Act of 1988, the federal government is required to approve state-tribal compacts, casino management contracts, and tribal gaming ordinances.
